      What is the procedure to apply for a divorce and how long does it take?

      A divorce procedure in India can extend for almost up to a year and in certain cases the disputes may continue for years. Due to the existence of diverse religious faiths in India, separate laws have been implemented by the Indian Judiciary in accordance with these beliefs. The following acts govern the divorce procedures in India:

      • The Hindu Marriage Act, 1955
      • The Parsi Marriage and Divorce Act, 1936
      • The dissolution of Muslim Marriage Act, 1939
      • The Special Marriage Act, 1956 (For inter-caste and inter-religion marriages)
      • The Foreign Marriage Act, 1969

      A contested divorce is filed on the grounds mentioned in the acts passed specifically for different religions.

      For a mutual divorce procedure in India, the partners can come to an agreement and resolve all kinds of disputes regarding maintenance, custody of children, and such.

      Under section 13B of the Hindu Marriage Act, a couple can file for a mutual divorce only after having lived apart for at least a year. The couple must jointly mention the unavoidable circumstances due to which they are unable to continue the marital relationship.

      The filing of a mutual divorce by both the husband and the wife is termed as the ‘first motion’. After a gap of six months, a couple can find for a second motion. This six months’ time span is provided to the couple so that they get the time to reconsider their marriage.

      Some important timelines to keep in mind:

      • A divorce decree can be passed before the 6 months are completed if all the mandatory documents are provided.
      • If the divorce file is not withdrawn within 18 months, the court passes a divorce decree.
      • In case one of the sides withdraws his/her petition, the court initiates to make an enquiry and if the concerned side disagrees to give the consent, then the court holds no right to pass the judgement
